Entrevista a Mario Maturana Claro, precandidato a convencional constituyente: “Las regiones deben autogobernarse para lograr el desarrollo”

*En entrevista con Diario Chañarcillo, el reconocido abogado presentó los principales puntos que su candidatura como convencional constituyente por el movimiento Independientes No Neutrales plantea como adiciones a la nueva constitución, y dio especial énfasis a la descentralización, los derechos sociales, la igualdad de género y los pueblos originarios.

(Por Rodrigo Ferrada).- En conversación con Diario Chañarcillo, el destacado abogado Mario Maturana Claro, de vasta experiencia en el mundo público, privado y académico, habló sobre su pre candidatura a convencional constituyente, y sobre las principales propuestas de cambio que a su juicio debería incluir la nueva constitución, incluyendo la descentralización, el reconocimiento de los pueblos originarios, la igualdad de género y la inclusión de los derechos sociales en la carta magna.

P: ¿Qué lo motiva a presentar su pre candidatura a convencional constituyente?:
R: Mi trabajo siempre ha sido de servicio público, he adquirido una experiencia y conocimiento de lo que es nuestra región, nuestra realidad,  lo que he adquirido en funciones que me han correspondido desarrollar primero como abogado, luego como miembro de la UDA, fui el primer secretario general y me tocó desarrollar jurídicamente la universidad, luego fui rector de la universidad por 9 años, en una etapa que crecimos mucho como institución, también he ejercido cargos públicos, llegué a esta región como fiscal regional de la libre competencia, luego el año 2000 fui designado fiscal regional de Atacama, con la tarea en ese momento de instalar el Ministerio Público, y estamos en un momento en que el país y la región se enfrentan a un tremendo desafío, con el proceso constituyente y la instalación del gobierno regional descentralizado, democráticamente elegido, lo que es un avance en nuestro país inmenso en el mejoramiento de la democracia, y también un tremendo desafío para los territorios, porque tenemos que aprender, no hemos tenido nunca la experiencia de gobernarnos, siempre hemos tenido un gobierno que está en el centro y nosotros obedecemos, ahora tenemos que fijar políticas para nuestros problemas concretos.

Eso me ha motivado siempre, el aportar al servicio público, al mejoramiento de nuestra sociedad y especialmente de su organización pública, eso me lleva  a pensar en volcar toda mi experiencia a un proceso tan importante, histórico y trascendente, como es la elaboración de una nueva constitución para nuestro país, pero a través de un sistema participativo, lo que es histórico, porque no se ha hecho nunca, todas las constituciones de Chile se hicieron en comisiones, en cuatro paredes, y luego propuestas en un plebiscito donde no hay ninguna oportunidad de hacer una crítica, sino que solo decir “si” o “no”, esta es la primera vez y es un tremendo desafío para nuestro país, por lo demás, la necesidad de cambiar la constitución obedece a mi modo de ver no sólo al hecho de que sea una constitución dictada en la dictadura y que no tenga reconocimiento por la ciudadanía, y en realidad ha sufrido tantas reformas nuestra constitución, especialmente  en el período del presidente Lagos, que es muy distinta a la de 1980, se terminó con los senadores designados, con el consejo de Estado que había, con el sistema binominal, por un sistema más amplio y participativo.

P: ¿A su juicio, cuales son las principales falencias de la actual constitución?.
R: Hay necesidad de cambiarla, estamos cambiando de época, la crisis que vivimos el año pasado con el estallido social, y la crisis de la pandemia este año nos han demostrado que el proceso de transición entre el gobierno autoritario y los gobiernos democráticos, ya cumplió una etapa, realmente la transición está terminando en este momento, y por eso necesitamos una constitución para los 40 o 50 años que vienen, donde viene otra etapa para nuestro país,  las constituciones en Chile y en todo el mundo tienen un período de vigencia y luego se agotan, porque entran en contradicción con los cambios políticos y sociales de la nación, que son dinámicos, eso hace que hoy necesitemos una nueva constitución especialmente para aplicar lo que aprendimos con el estallido social y con la pandemia, aprendimos que el Estado tiene que ser más social, más solidario, que no basta el sistema de mercado para terminar con las desigualdades, con la pobreza, hay que regular el mercado y dirigirlo hacia la igualdad de todas las personas, de ingresos, de oportunidades, de educación, salud.

Yo creo que las principales falencias tienen que ver con varios aspectos, en primer lugar tiene que ver con el sistema de gobierno, tenemos un gobierno centralizado, y además con un híper presidencialismo, eso está demostrando en primer lugar que si Chile no se descentraliza y no entrega a sus regiones la capacidad de autogobernarse  y autodesarrollarse, el proceso de desarrollo, social, político y económico del país está paralizado, la idea es entregarle a las regiones la capacidad de resolver sus problemas porque los conocemos mejor que el centro. Y eso va a agregar al desarrollo 16 motores, hoy el desarrollo de Chile, tiene un solo motor, el gobierno central, pero ahora queremos agregarle un motor en cada región y para eso tienen que darnos las facultades para autogobernarnos, eso en la normativa constitucional y legal, no está, entonces hay que ir a la constitución a fortalecer la idea de un Estado unitario, nunca vamos a ser un Estado federal, para eso tiene que haber varios estados antes, que se asocian, nosotros siempre hemos sido uno solo, pero necesitamos ahora que sea descentralizado.

P: ¿El presidencialismo también influye en esto?.
R: Si, tenemos un presidencialismo híper poderoso que tiene pies de barro, en el sentido que si no tiene mayoría en el congreso, no puede gobernar, que es lo que está pasando hoy día, ese problema hay que resolverlo, vinculando el congreso al gobierno, no puede estar el congreso solo para la dictación de leyes, sin llegar a ser un régimen parlamentario, tenemos que hacer uno mucho más integrado entre el presidente y el congreso, de manera que haya más flujo ahí y menos iniciativas exclusivas del presidente y más no solo del congreso sino que también de la ciudadanía. En ese sistema también queremos avanzar desde una democracia tradicional que tenemos, bastante abandonada en los países más de avanzada, a una democracia participativa, donde además de elegir a los representantes del congreso y al gobierno central, podamos participar de las decisiones más importantes, y también en la generación de leyes, muchos países tienen sistemas donde un conjunto de ciudadanos puede presentar un proyecto de ley y llevarlo al congreso, lo que hoy es imposible.Plebiscitos, consultas ciudadanas, pero que sean de alguna manera vinculantes, de manera que la ciudadanía participe del gobierno, eso no es una utopía, antiguamente era muy difícil por las comunicaciones, el conocimiento que tenían las personas respecto de la realidad nacional y mundial era muy escaso, pero hoy es inmenso,  con la tecnología hoy las personas tienen conocimientos sobre muchas cosas,  tenemos una ciudadanía mucho más informada.

P: ¿Cómo debiera incluirse en la nueva constitución a los pueblos originarios?
R: Tenemos que resolver ese tema que no ha podido nuestro país, por falta de acuerdo, el tema de los pueblos originarios. Desde el movimiento que yo participo como candidato, que es Independientes No Neutrales, porque tenemos ideas, estamos por un Estado, y muchas naciones, plurinacional, siempre vamos a tener un Estado, el de Chile, pero que en él convivan varias naciones y etnias, porque el Estado es la organización jurídica de la sociedad, la nación es el conjunto de ciudadanos y su cultura, sus pensamientos e ideas,  entonces hay que reconocer el carácter de naciones, a los pueblos originarios, y además reconocer su cultura”.

P: ¿Hace falta incluir en el catálogo de derechos fundamentales los derechos sociales?
R: Indudablemente, en relación con los derechos garantizados por la constitución que se denominan derechos humanos, hay que comprender que la idea de derechos humanos es un producto de lo jurídico, que parte de la dignidad que tenemos como personas, tenemos algunos derechos inherentes y eso es valioso instrumentalmente, porque siendo un derecho el Estado tiene que respetarlo, preservarlo, protegerlo. En ese contexto hoy en día hay derechos mucho más avanzados entre los cuales están los derechos sociales, que debemos incluir en la constitución con el objeto de hacerlos realidad a través del sistema jurídico, establecer la obligación del Estado de asegurar derechos sociales a todas las personas, y no estamos hablando de derechos sin ninguna medida, sino un mínimo que corresponde a la dignidad de las personas que tiene que ver con la seguridad social, pensiones, vivienda, salud, educación de calidad pública, como mínimo para todas las personas, y eso tiene que estar en la constitución de manera que el Estado pueda generarlo.

P: ¿El tema de género también debería ser incluido en el nuevo texto constitucional?
R: Entre los propósitos y principio del movimiento de Independientes No Neutrales, hay un gran énfasis en la igualdad de género, que es un tema en que llegó el momento en que tenemos que hacernos cargo de una cultura patriarcal, en que se ha postergado a las mujeres desde todo punto de vista, en sus derechos políticos, sus derechos laborales, a igualdad de remuneraciones, es una cuestión que estaba naturalizada, pero en los últimos años nuestro país a través de movimientos especialmente universitarios, se ha ido demostrando que esto tiene que terminar, tenemos que tener a la mujer en la misma condición, pero para eso hay que hacer una discriminación positiva, intencionadamente, proponer y desarrollar procesos que la coloquen en igualdad oportunidades, y así vamos a crecer como país, por eso queremos que la constitución tenga un sello de igualdad de género.

P: ¿Qué mensaje daría usted a la ciudadanía en pos de su candidatura?
R: “Quiero enfatizar, que este es un grupo de independientes, no neutrales,  porque tenemos ideas de lo que queremos hacer, y como independientes, estamos en una carrera cuesta arriba en relación a los partidos políticos que no requieren firmas para inscribir candidaturas a la convención constituyente, en cambio nosotros sí, en Atacama necesitamos alrededor de 600 firmas como lista, invitamos a las personas que quieran a apoyarnos como independientes, a firmar en las notarías en toda la región, y también se puede hacer en la página de Servel www.servel.cl, con clave única, llamamos que nos apoyen con la firma, que es el patrocinio para inscribir la candidatura antes del 11 de enero, y llamar a la que la gente se acerque a nosotros y conozca nuestras propuestas”.
