El Chañar pasa a ser “especie vulnerable”: Queda prohibida su corta, eliminación o alteración de su hábitat

Hasta esa fecha, la corta del chañar estaba regulada por la Ley 20.283, sobre Recuperación del Bosque Nativo y Fomento Forestal, pero al ingresar a la clasificación de especies en la categoría de vulnerable.

Una nueva normativa en conservación más estricta rige ahora para el chañar (Geoffroea decorticans), luego que ingresara a la clasificación de especies en la categoría de vulnerable (VU), según la publicación en el Diario Oficial del Decreto Supremo N° 44 del 30 de diciembre de 2021.

Hasta esa fecha, la corta del chañar estaba regulada por la Ley 20.283, sobre Recuperación del Bosque Nativo y Fomento Forestal, pero al ingresar a la clasificación de especies en la categoría de vulnerable (VU), se aplica el artículo 19° de esta ley, la cual señala que: “Prohíbese la corta, eliminación, destrucción o descepado de individuos de las especies vegetales nativas clasificadas de conformidad con el artículo 37° de la Ley 19.300 y su reglamento, en las categorías de ‘en peligro de extinción’, ‘vulnerables’, ‘raras’, ‘insuficientemente conocidas’ o ‘fuera de peligro’, que formen parte de un bosque nativo, como asimismo la alteración de su hábitat”.

Al respecto, el director regional de la Corporación Nacional Forestal (CONAF) Atacama, Héctor Soto, indicó que ésta fue una iniciativa regional, donde participó el Ministerio del Medio Ambiente, Universidad de Atacama a través del CRIDESAT y CONAF, producto de que esta especie se encuentra amenazada por la corta y habilitación de terreno indiscriminada por parte de algunos propietarios de parcelas de agrado, su integración a esta lista de protección permite que “además de prohibirse su corta, eliminación o de comprobarse algún daño, se aplicará una multa de entre 5 a 50 unidades tributarias mensuales por ejemplar (de 272.210 a 2.722.210 pesos, a la UTM actual), si éste no tuviere valor comercial. En caso contrario, la multa será igual al doble del valor comercial de cada ejemplar objeto de la intervención”.

Por su parte, el seremi de Agricultura, Patricio Araya, celebró esta nueva legislación, que da herramientas para cuidar y proteger la flora nativa, ya que el pasado 7 de enero del presente año “se recibió una denuncia de terceros sobre corta de bosque nativo de chañar en el sector Margarita”.  

Además, el artículo 19° en su inciso segundo, establece que excepcionalmente se podrá intervenir o alterar el hábitat de los individuos de dichas especies, siempre y cuando, las intervenciones o alteraciones cumplan las siguientes condiciones copulativas: Tengan por objeto la realización de investigaciones científicas, fines sanitarios o estén destinadas a la ejecución de obras o al desarrollo de las actividades señaladas en el inciso cuarto del artículo 7° de la Ley N° 20.283 (construcción de caminos, ejercicio de concesiones o servidumbres mineras, de gas, de servicios eléctricos, de ductos u otras concesiones o servidumbres reguladas por ley) siempre que tales obras o actividades sean de interés nacional, sean imprescindibles y no amenacen la continuidad de la especie a nivel de la cuenca o, excepcionalmente, fuera de ella.

Otro aspecto importante de resaltar es que la ley señala que “esta prohibición no afectará a los individuos de dichas especies plantados por las personas, a menos que tales plantaciones se hubieren efectuado en cumplimiento de medidas de compensación, reparación o mitigación dispuestas por una resolución de calificación ambiental u otra autoridad competente”

El chañar, en la Región de Atacama, se distribuye en los valles de Copiapó y Huasco, formando bosques puros y asociados a otras especies nativas como espino (Acacia caven), pimiento (Schinus molle), algarrobo (Prosopis chilensis) y también Prosopis flexuosa.

La ficha para que la especie integrara el listado de clasificación de especies fue presentada al Ministerio de Medio Ambiente por parte de Roberto Contreras, CRIDESAT, Universidad de Atacama; Boris Burgos, CONAF Región de Atacama; César Pizarro, CONAF Región de Atacama; Álvaro Parra, seremi Medio Ambiente Región de Atacama; y Héctor Soto, director regional CONAF Atacama.
